EP patents to cover Marocco
As from March 1, 2015 it will be possible to designate ("validate") Marocco for European patent applications.
On December 17, 2010, the President of the European Patent Office and Morocco's Minister for Industry signed a validation agreement. This agreement enters into force on March 1, 2015. European patent applications and patents validated in Morocco will confer essentially the same protection as patents granted by the EPO for any one of the EPO member states.
Validation in Morocco occurs at the applicant's request and can be requested for any European or international application having a filing date as from March 1, 2015. It is not available for applications filed prior to that date, or for any European patents resulting from such applications.
The time limit for paying the validation fee is the same as that for paying the desig-nation and extension fees, i.e. six months of the date on which the European Patent Bulletin mentions the publication of the European search report, or within the 31-month time limit for European phase entry, respectively. After expiry of the relevant basic time limit, the validation fee can still be paid with surcharge within a two-month grace period. If the validation fee is not paid in due time, the request for validation is deemed withdrawn.
